At the trial to day it was clearly proven by the witnesses of the opposite side, that the Boy Tom, did not fire his Pistol, until he had been fired upon three distinct times - notwithstanding, he was held by the magistrate for trial, as previously stated.
The Sworn testimony of the witnesses for the defendents, both went to prove that the Boys were leaving the premises, when they were followed up by Mr Preston, and his Son in Law, both armed with Revolvers, and who first made the attack.
On the other hand Mr Preston did not deny raising his Revolver, in the position to fire, but affirms that he only cocked the piece, and did not snap the cap, as was proven by the opposite side. He further stated that he fully believed that the Boys has malicious intentions against him -
