To Capt. S.W. Carpenter

Sir:  In reply to your request that we should furnish you a statement of the Case of J.J. Robinson v.s. Mrs. Carpenter in detinue for a Red Steer (lately tried before us as Justices of the peace in the County of Madison) on Warrant.  

We would respectfully state that the difficulty is between the said Robinson and Mrs Carpenter who is the step mother of the wife of the said Robinson and grows out of Cattle sold as the property of the estate of Henry Carpenter decd, the father of Mrs. Robinson.  Mrs. Carpenter having purchased a portion of said Cattle and the said Robinsons having purchased a portion, and in the lots of each there was a Red Steer.  

In the progress of the trial Mr Robinson introduced (as evidence in the case) the Sale Book, from which it appears that the 1st lot of Cattle sold, was a Red and a Roan steer and was knocked off to a Mr Richards at $42.00 Robinson being the competing bidder. The second lot described as a Red and a spotted steer was knocked off to J.J. Robinson at $34.00  the 3rd lot 2 steer not described, knocked off to the said Robinson at $32.00  These cattle were proved to be all nearly [[strikethrough]] all [[/strikethrough]] of the same age and size.  

At about the 3rd day after the sale Richards not having complied with the terms of the sale, it became necessary that the lot of Cattle purchased by him should be resold, and a coloured man was sent by the said Robinson and the Adm'r of Henry Carpenter to the field to drive in the pair of steers which had been previously knocked off to Richards.  

Giving the said coloured man directions what Cattle to bring up, but before the Cattle arrived a sale had been made to Mrs. Carpenter.  Thos. E. Rowfie
