hold the one assigned to him and when he wished to ride took that one. In the fall the horse died, as did one of those brought by the other Col'd man - the one chosen by Mr Walker. This left but two horses one claimed by Mr Walker, the other by the servant who went with Henry. Henry worked until the fall of 1865 and left Mr Walker - the following Spring he made application to Bvt Lt Col J.W. Powell then Asst Supt at this point for the horse in possession of Mr Walker (as numerous others were doing) and obtained an order of Court, May 8th 1866 that the horse be given to him (Henry) on the 26th of Dec 1866.  He (Powell) was soon after superceded by Lieut Robt N Cullen who saw fit I am verbally informed to send for Mr Walker and tell him not to give up the horse, that it was an unjust decision - this does not appear upon the books of this office but I have reason to believe that it is a truthful statement on the part of Mr. Walker - Mr Walker therefore refused to deliver the horse to Henry, and on the 24th of Jan. 1867 he appeared before me and asked assistance. I finding the decision of May 8th 1866
