I am compelled to doubt very much whether Cumby ever saw this horse till seen in the possession of Mr Dickerson in the summer of 1866, though Cumby may be sincere in his opinion.

If you feel it your duty to open this case for an investigation allow me to as you to do me the favor to notify me of the time & place of the trial & allow me to represent the Est: of Thos. R. Marshall & introduce such evidence as I may be able, to show that Cumby has no legal claim to this horse - Jas Marshall wrote me a few days ago & I wrote him in substance I believe the same as this.
