Charles White, Page Walker & Saml H Moss, as partners bought a Wagon for $35. such paying the sum of $11. 67/100 Dollars, - subsequently in some small transactions, Plaintiffs became indebted to Defendant in the sum of One dollar and 51 cents Each. - Defendant without any authority seized said Wagon in June following and appropriated it to his own use, refusing to indemnify Plaintiffs in the amounts, advanced by them, in the purchase of said Wagon | That if either party conclude to take the Wagon that he be permitted to do so, upon paying to the others the amount advanced by them, if not - then the Wagon to be sold, at public sale, and the proceeds placed in the hands of the Commissioner to be equally divided among the parties after settling the small a/cs alluded to, which the parties declined to do. Ordered, That the Wagon after ten days notice be sold, and proceeds disposed of as aforementioned. |
