Robertson | Assault and Battery and unlawful shooting upon the person of "Stephen Scott," Cold" | Evidence proved that the Defendant had had a dispute with Scott, and beat him, Scott not returning the blows, the morning following Defendant took his gun and without warning fired in the direction in which Scott was passing on the highway. Defendant offered no excuse for his course other than having received impudence from Scott | The Defendant was fined $15,00 and Costs and placed under $200. bonds to keep the peace for 12 months | Case tried by Justice Knight of Lunenburg County who dismissed complaint of Scott, contrary to law and the evidence in the case  Case then reopened by Military Commissioner |
