The foregoing notes embrace an area of ninety seven and three quarters acres including the one third part of fifty four acres which belong to Dr Wm. E. Wood. That fifty four acres includes a jib across the road which Col Mallory claims as a part of Oakland and containing 3 1/2 acres. If Mallory is entitled to it, then Dr Wood is only entitled to 1/3 of Fifty and a half acres which is 16 5/6 acres
