as to make in his judgement unprofitable & inexpedient to do so, at which time whatever if the stock of goods may remain on hand the Trustee is authorized to sell at public auction for cash and to enable him the better to accomplish this object he is hereby authorized & empowered to employ an agent or salesman to take charge of the store Lease and stock of Goods now in hand until such time as he may think it expedient and proper to close the Hours and sell at auction such agent or salesman to be paid a reasonable compensation for hi services and of the Trust fund. Should any question arise in regard to the Scaling of any of the debts & credits its hereby transferred & assigned or the debit hereby secured in this Deed which were contracted in Confederate Currency. The Trustee is hereby empowered to adjust them upon such terms as he may deem equitable The Books accounts Bonds Notes debts, Judgements rights to credits - hereby transferred and assigned the Trustee is authorized and directs to proceed to collect as property as maybe practicable in making such collection he will sue or not at his discretion. A schedule of the bonds & notes transferre & assigned by this Deed Marked "A" is hereto appended as apart of this deed. The proceeds of the property & stock of goods hereby conveyed and of the Books accounts bonds notes rights & credits hereby transferred & assigned. The trustee is directed, after paying the expences of making & executing this Trust including a Commission of five per cent to the trustee, to apply as follows ~ To Wit. ~ First to the payment satisfaction & discharge of the debts & liabilities hereby Secured or intended to be secured designated as Debts of the first class, and Secondly to the payment satisfaction & discharge of the debts & liabilities hereby secured or intended to be secured designated as debts of the second class. And thirdly to the payment satifaction & discharge of the debts & liabilities hereby secured or intended to be secured designated as Debts of the Third Class, and that the surplus, if any, be pay over to the Said A Boyd & son or their order, Witness this following signature and seals.

In the Clerks office of Mecklenburg County Court June 2d 1866 The foregoing Deed of Trust together with a Schedule marked "A" appended then to, was this day acknowledged in the Clerks office aforesaid, by A Boyd Wm R. Boyd S R Johnson to be their act and Deed, and with Internal revenue stamps of the value of $60.00 adhered then to and duly cancelled is admitted to record
