R E S O L U T I O N No. 33-35

WHEREAS, it has been brought to the attention of the San Carlos Apache Tribal Council that the commissioner of Indian Affairs, under date of May 16, 1955, issued a memorandum to all Area Directors regarding insurance of patents in fee to competent applicants, which memorandum is a complete change in policy and has been adopted without consent or consultation with the Indians affected, and

WHEREAS, if the policy as announced by said memorandum is permitted to stand, the basic principles of land use and conservation will be violated, and

WHEREAS, the policy as announced would have a detrimental effect on those reservations were a great deal of said land is allotted and subject to fee patenting and will materially affect and efficient operation of the activities in developing the resources  on said reservations and would further break down the discharging of the trust obligation that the Government owes to the tribes; now therefore be it

RESOLVED by the San Carlos Apache Tribal Council in special meeting assembled this 18th day of July, 1955, that it is opposed to the change of policy as announced by the memorandum of May 16, 1955, regarding patents in fee, and said Council respectfully urges and requests the Commissioner of Indian Affairs to retract said memorandum and permit the policy to remain as previously set forth in the Indian Manual, Section 201.01, Chapter 2, Part 9, Volume 5; and be it further

RESOLVED that the delegates to the annual convention of the National Congress of American Indians are hereby instructed to present a copy of resolution at the said convention.

CERTIFICATION

I, the undersigned, Acting Secretary of the Council, hereby certify that the Council of the San Carlos Apache Tribe is composed of 11 members, of whom 10 constituting a quorum, were present at a Special meeting thereof on this 18th day of July, 1955, and that the foregoing Resolution No. 33-35 was duly adopted by an unanimous vote of the Council, pursuant to the provision of Section 1, (a), Article V of the Amended Constitution and By-Laws of the San Carlos Apache Tribe, approved April 19, 1954.
