as would bring this man to justice.  The principal witness was not found.  The prosecution was badly conducted.  No argument was made and no motion for a new trial.

I would bring him ("the Commonwealth Attorney") to your notice as a case for removal on the grounds of "incompetency" and "partiality" in the discharge of his official duties.

The accused (C.H. Earheart) was arrested by order of the Post Commander after the result of the trial became known to him.

The decision is so notoriously unjust and so hazardous to the "peace" that I respectfully request your immediate action.  Attention is invited to a communication relative to the case on the 3d of April 1868.

The testimony of Squire Barton a Magistrate sitting on the trial and Sergt. Forrest, Lt. Reed and Dr. W.A. Dunwiddie will sustain the above charges.
