this worshipful court hath no Jurisdiction to try him Upon the said Indictment, and that he ought not to be compelled to answer to the same because he saith that he the said Robert Doswell hath never been duly and legally examined and committed for Trial before this court for the offence charged in the said Indictment prior to the finding thereof before & by any Justice of the said County of Hanover or otherwise in conformity to Law, and because he has never been in any manner legally before or in the custody of this worshipful Court for trial for the said offence charged in the said Indictment:  And this he is ready to verity.

Wherefore the said Robert Doswell prays Judgement of this worshipful Court, will further proceed to try him upon the indictment aforesaid &c
