   I certify that I has present when Mr Rowzie and Jackson Wells had a settlement and that Mr Rowzie first proposed to Wells that he should select some friend and Wells another friend to settle between them.  Wells refused, and said they could settle and then I was called on as a  witness to their settlement.  Mr Rowzie produced an account against Wells for loss of time, and for additional labor furnished and also for supplies furnished.  Wells all of hich Wells acknoweldged as just and reasonable.  Wells then received one and  a half barrels of corn and one stack of fodder and one of hay.  Mr Rowzie then bought the hay and fodder of Wells for ten dollars. Mr Rowzie sd he would retain 1 1/2 barrels of corn until Wells paid him the balance for additional labor &c.  to which Wells did not then object, but then agreed to haul 1000 rails for Rowzie at 50 cents per hundred in
