Respectfully returned. The 6th S. Ch 204 p 824 of code of 1860, authorizes the committing justice to let to bail a person charged with a capital offense in cases where only suspicion of guilt attaches to the accused. The probability of guilt of course to be decided upon by the justice. 

I find nothing that conflicts with this provision and am therefore of opinion that the offense with which Doswell was charged was bailable
