Lewis asked him to govern his passion which caused threats of violence to which Lewis responded in substance than that was more than his father or mother had ever said before him- much less had they ever done anything of the kind.

Doswell became still more enraged and after threats that he would "kill him," dealt him a heavy blow upon the back of his head with the grubbing hoe which he held in his hand, Lewis fell to the ground and died almost instantly.

A Mr T.L. Jones. called a coroners inquest; and the jury brought in a verdict that the dec'd came to his death substantially as stated above; but that the deed was committed "without malice or premeditation" upon the part of Doswell.
 
A preliminary trial was held before Justice J. Alonzo. Smith, who committed the accused to bail in the sum of two thousand dollars ($2000.00), his father giving his security. Not considering however
