I enclose herewith a statement of Justice Thompson, together with a copy of the warrant issued in the case, which shows that G.N. Thompson made oath - not that Haines, in his belief, "was about the leave the state", but that he believes "his tenant would remove his effects from the leased premises before the rent would become due." It appears, however, that the action of the County Court was based upon the first form of oath.  If this error had not been committed there would appear to be no illegality in the proceedings, nor, in fact, any injustice upon the part of anyone, especially in consideration of the experience of the lessor the preceding year.
I have just received word that the property levied upon is to be sold on Saturday, the 5th inst. and our requested to take action to cause the proceedings to be stayed.  I forward the case for such action as the proper authority may deem proper.
