was asserted, at the time Jones was shot, why did he not bring witnesses to prove same.
The case is one so patent of injustice and mockery in the name of law, that I as a Virginian blush for my countryman and hide my face with shame, when I hear the word justice and shudder at the thought that a day of retribution is approching.

DYING DECLARATION OF PEYTON JONES.

September 2d, 1868.}
I Payton Jones, do solemnly swear before Almighty God, in making this my dying statement, that on the 11th day of August, eighteen hundred and sixy-eight, I left the farm of Franklin Stears, on the River Road, on or about four (4) miles from the city of Richmond, State of Virginia, and proceeded to the office of Franklin Stearns, on Fifteenth stre3ed, between Main and Cary streets, in said city, arriving at said office on or about seven o'clock A.M.  I staid there about one hour and a half.  I spent the rest of the day in walking round to the "Old Market" where my attention was attracted by a large crowd of persons, and the burning of tar barrels, where the rooster was on the "pole."  I walked round the side of the house and sat down on or about two squares from the meeting.  I saw two white men walking up the street, and when they saw me one of them went towards the cars and the other came up to me and drew back and struck me with a pistol on the nose.  I know it was a pistol for I saw it in his hand.  I jumped up and ran, and looked sideways to see if he was following me when he shot me when I fell, then holloed.  I think I would know the man who shot me if I was to see him.  I reckon my age is about twenty-seven years.  I was born in Nottaway County, Virginia.
