The other col'd man who was in range was also hit, but not materially injured. I have not his name at this time and have thought best not to defer the report in order to obtain it. I will ascertain and forward at the earliest possible moment. His injury was light and he testified that the shooting was accidental so far as he was concerned. Rice was presented for the unlawful shooting of this man, but the Grand Jury failed to find a True Bill.

After the shooting Rice went immediately and gave himself up to Dr. J.G. Lumpkins J.P. and stated to him that he shot Powell intentionally, but the other one by accident. He also asked Dr. Lumpkins to give them his professional attention, In the meantime, another physician had been sent for, learning which Dr Lumpkins held Rice for examination, which took place on Monday the 23d, with the result named in my Monthly Report. 

At the November term of the County Court, the Grand Jury found a True Bill against Rice for the felonious shooting of Powell
