George Shepard [[?]] followed for prosecution and swore that none of the men had such cloths or masks over their face, but from dress, height, voice or general appearance swearing to  Thos. H. Rice, Zack, Griffin (cold) Stephen Farmer, William H Pinyear, Henry Spencer, Ada Spencer and Samuel Shepard withdrawing his charge against William Shaw for the reason he had since ascertained that Shaw had gout and could not have walked there-
Shephard in cross examination could not testify more than he "thought so" he "felt sure" but could give no points of identification Anderson Sniddy who was badly beaten could not identify any of the men except one who he swore was Henry Spencer. Rhoda Sniddy  who was present could not identify any others and made the further admission that although she saw the men beating one person she did not know until afterward, that person was her husband
