I was too late on Monday after I got there to do anything in the case except to summon witnesses and send for other magistrates, on Tuesday morning myself and Mr Mosley arrested Roberts, and proceeded with him to Mr Palmer's place where the wounded man lay. on arriving there we turned Roberts over to the Constable who took him in charge, all the witnesses for the Commonwealth were present, but on asking Roberts was he prepared to go into trial he said no, as there was two important witnesses at and near Charlotte Court House that he wanted summoned, whereupon the court adjourned over to Wednesday and the constable went to summon Dr. P.H. Flornoy and a Mr Roach, before starting however he the (Constable) turned the Prisoner over in charge of three men? On Wednesday morning we met at the same place. Mr. John F. Mosley, Mr. R.F. Barns and Mr Edward J. Dickerson were the magistrates that constituted the court. we first went and examined Ruben Johnson the wounded man, who swore that without any just cause whatever, that Roberts struck him on the Head with his Pistol Knocking him (Ruben) senseless, he afterwards heard the report of a Pistol but did not know he was shot which is about all he could tell, on being asked by the Court did he do or say anything to enrage Roberts, he said no except that he told Mr Roberts that he could not walk so fast, whereupon Roberts ordered him to walk up in front.
