Required me to Report that case. Mr Wartman Requested me in my Report to draw a distinction between the Court and the Jury declaring the Court were unanimous in the opinion I had expressed that the verdict was not in accordance with the evidence, On the next day another case was tried the facts were then a man much stouter in appearance had struck another white man with a stick knocked him down inflicted a wound two inches long in his head injured him so much he had to be led home and all without provocation, The Jury brought in a verdict not guilty, Mr Wartman came to me asked me if I heard the evidence and what I thought of the verdict, I told him such a verdict was not warranted by the evidence, he said the Court agreed with me, and said he could not account for such verdicts only in this way, there was so many cases of that kind that he thoughts the Citizens were determined to keep them out of Court.

Mr Wartman then called my attention to a case in that Court where a Freedman had sued a white man on an open account claiming One Hundred Dollars, There was no testimony introduced in either side but their own and they [[sure?]] square up against each other, verdict for the Freedman for One Hundred Dollars, The council for defendant applied for a new trial the Court Refused it, I became satisfied the first verdict in which the Freedman was interested was not on account of Color and did not Report the case
