Charles Johnson, colored, rented from John Porter, white, 50 acres of land for the years of 1866 & 1867, with the privilege of pasturing horses cattle and hogs (all blank) During the summer of 1866 two stray yearling calves crossed the Rappahannock river from Culpepper County, in the field of corn, of said 50 acres, and after bothering Johnson for some time he turned them in the pasture where he pastured his other stock, where they remained until feeding time, in the following fall or winter. They appear to have been wintered upon the fodder of Johnson & Porter 2/3 of which was Johnsons and 1/3 Porters. They remained on the place the following year (67) until about Christmas, but it was agreed upon the spring of '67, as Johnson alleges & proves, between him & Porter, that, inasmuch as no owner had ever come for them, they would divide the two creatures, Porter take the steer & Johnson the heifer. Sometime about last Christmas Johnson went to Porters after said heifer, appearing as he says, that there could be no
