The Peace since the war The above four Justices constituted the court before whom R. H. Waddell was tried for the murder of Henry Clay and acquitted.

Three of the Court Micajalo Davis N.F. Thaxton and Corneline Pat and by the XIV article amendment to the constitution of the United States disfranchised and disqualified from holding Officer Therefore I would respectfully request that R. H. Waddell be arrested and tried by a court of compitent legal jurisdiction. A court of compitent jurisdiction (to try felonies) must by the code of Va (Chap 157 Sect 15 - 16- 17 & 18) as amended by Act of Assemble (p. 944) be composed of three or more Justices and W. N. Joplin was the only legal number of the above court.
The Indictment against Waddell was found on the 30th day of July 1868 and the findings of the jury were on the 4th day of August 1868 both of which were after the Honorable Secretary of State of the United States had published officially
