[[circumstan]]ces. I thought Dr Miller the proper person to take charge of the children as that was without doubt the wish of the nearest living relative. I then requested Dr Miller to inform me, with as little delay as possible, to whom he desired to have the children bound, in order that I might make out the papers of indenture. Since then I have heard nothing from either of the parties. I had supposed that the matter was settled, and was looking daily for word from Dr Miller, with a view to the final disposition of the children.

In fact had it not been for his representation that it was the desire of the Grandfather, within referred to, that he should have the control of the children, they would have been bound out some time ago, as Mr Fox had made arrangements for that purpose which I approved. 

My action in this case has been controlled, perhaps unduly so, by the order requiring, when practicable the written consent of the nearest relative, in the binding out of orphan children.

Under the present circumstances of this case, I shall now feel it my duty to take the matter into my own hands, and
