Geo. B. Diffenderfer, a Justice of the Peace, and he at first refused to issue a warrant, but on my applying to him for an explanation he did issue a warrant, but Mr Latham chose to appear before Mr Samuel Atwell J.P. who heard the testimony, in which the fact above stated are clearly proven, and indeed admitted by Latham, and dismissed the case with cost to prosecutors. 

Mr Atwell stated to me, that Mr. Latham had a right to go into this womans house and take the law into his own hands. That it was of no use to apply the law to negros in such cases as this.

I transmit herewith affidavits supporting above statement, and respectfully recommend the removal of Mr. Atwell from office, and the appointment of some person who will not place himself above the laws he has sworn to observe and enforce; and his own judgement superior to the authority under which alone he acts.
