General:

My Report for July 1868 on Result of turning over Jurisdiction in Criminal Cases, having been returned to me with your objections endorsed thereon, I respectfully beg leave to offer the following explanations, and Report.

I regret that my purpose in making the report in the form I did has not been fully understood.

I did not think it a case requiring the interposition of Military Authority, and so stated on the third page.  Mr. Mooney, a brother of the Mooney killed by Dandridge, insisted that it was such a case, and repeatedly assured me that he should take measures to bring the matter to the notice of General Stoneman.  He stated that the whole matter had once been examined by a Military Commissioner, that all the papers were on file in Gen. Stoneman's office, and that he had been assured by General Schofield that justice should be done by the military authorities, if the Courts failed in their duty.  Thinking it probable that Mr. Mooney might succeed in getting the matter inquired into I thought proper to give a fair and impartial statement of what occurred at the trial, so that Mr. Mooney might have the benefit of any illegal and irregular proceedings, should this report be inquired for.

When in Richmond soon after forwarding the report I called on Lt. Ward and informed him, that, should the matter be brought to his notice, and, should he deem my views of any importance before initiating
