Booker Bell. | Harrison Winn | Plaintiff charges defendant with catching and penning up his hog and refusing to give him up when he produced evidence to prove that the hog was his property and that Defendant subsequently turned out or made away with the hog, which can not now be found. | Evidence sustains the charge, showing that Def't did pen up the hog of Plaintiff and refuse to deliver up the same when demanded and proof of ownership produced, that he subsequently turned out or made away with the hog, which can not now be found, and that the value of the same is ten dollars. | Judgment for Plaintiff for the sum of the ten dollars, value of the hog, and ten dollars for damages sustained by him by reason of the detention and loss of said hog and two dollars and seventy two cents costs. Execution issued for $22.70 | Case tried by Justice Jackson, of Lunenburg County, who gave judgment for only $7.00 ignoring the fact of the wrong done Plaintiff and the damages sustained by him. Military Commissioner reopened the case. |
