I have the honor to submit the following as my reply to the accompanying communication addressed to Maj. General O.O. Howard, Commissioner, by the Thorntons, Baylor & John.

At the time of the arraignment of the said Thorntons before the County Court of Gloucester County Va for an assault &c upon upon one John H. Tabb, (an elderly man of sixty years)  I was on leave of absence for Qurs. Asst. Comr. Richmond Va. May 21st 1868   This leave of absence reached me through your Office May 26th. It then being near the close of the month, and activated by a desire to forward the monthly papers due from this office I postponed my departure till the 30th when I availed myself of the leave of absence - This explanation will account for my non appearance at County Court - Gloucester County - June Term - 1868

On the 19th of August Baylor Thornton called upon me to interfere to the extent of interfering to prevent the execution of a writ issued by Authority of said Court to recover his costs and the amount imposed in fines in the case of Commonwealth vs Thorntons -  I informed him of the impossibility of my interfering in the matter so far as to compell the Sheriff to desist from the discharge of a duty imposed by the Court.  Assuring him at the same time that the matter between him and the Court should be investigated at the next term of Court (September) and if then it appeared that
