thus placed across the said lane to prevent the cattle and other stock belonging to neighbors from trespassing upon our growing crops.

In an angry mood the said Tabb approached us and demanded [[strikethrough]] to know [[/strikethrough]] to know of us why we had placed the said "draw bars across the the said lane, (which said lane was the only outlet we had to the county road)

I answered his demand by the reply that my contract with him assured me the possession of the lane so far as it tendered to my convenience, and moreover, that I had a right to put up the said "draw bars" as a barrier, for the protection of my crops, inasmuch as the said lane, or a portion thereof, was included in the twenty one acres covered by said contract.  He the said Tabb replied that the said "draw bars" would not by him be permitted to remain, and if I did not remove them, he would prosecute me, and that the said lane was not included in the twenty one acres covered by the contract.  I replied by calling upon him the said Tabb for a survey of the land I had leased from him.  This he refused, and moveing away, said, you are working in Taleifero's interest and if you dont move them I will prosecute you (meaning the "draw bars")   I replied that he could not prosecute me for what I had done.  He replied, I will be up with you and call a court.  Here this matter of trouble was dropt and nothing further of a disagreeable character occurred between us till about the 1st of May, 1868, when myself and brother John had seeded a portion of the said 21 acres with wheat and to protect this growing crop - by which when harvested we expected to realize
