Gloucester Ct. Ho. Va. Sept 26th 1868

Dear Sir,
Your letter of the 14th inst. came to hand by due course of mail and found me incapable of using my right hand. I saw Mr. Wm B. Seawell on the subject and he said that he had promised you to make out a statement of the case of the Commonwealth vs. John and Baylor Thornton, and I intended to have endorsed Mr Seawells statement so far as my reccolection of the evidence agreed with his and to have noted briefly the discrepancy in (case) any should exist I have seen Mr Seawells statement of the case and it entirely and fully agrees with my [[strikethrough]] ne [[/strikethrough]] reccolection of the testimony, the verdict of the jury, and the sentence of the Court.
I know nothing of the executions issued for the costs and fines They, however, are of record, and official copies may be obtained from the Clerk. I will add that I was one of the Court in the trial of this case and was in favor of imprisoning the parties for a longer term than the Court fixed, because I have never adjudicated such an unprovoked and aggravated a case of Assault in a Service of twelve or fifteen years on the bench.
