indictment it appears that W. F. Tyree and Charles H. Sweeney were witnesses who were acquainted with the facts and circumstances.

I respectfully request that their testimony may be taken and sent to me as soon as convenient.

I return the papers in the cases of L. winder which is very peculiar in its character, and request that some one living in the neighborhood may be directed to take testimony to determine the merits of the case.
