Colonel,
I have the honor to forward herewith copy of a report of a trial of R.H. Waddell, white, for the murder of Henry Clay, (cold) by the County Court of Bedford Co.
   
In view of the frequent occurrence of cases, in which colored men are killed by white, and the almost certain acquittal of the criminal after the solemn farce of indictment and trial, without regard to any, and often against all evidence, and of which cases, the one now forwarded is simply taken as a sample, because it is the latest reported, I would respectfully but urgently recommend, that hereafter all cases of this character be tried by Military Commissions as provided for and authorized by Sec. 3, of the Act of Congress, entitled an "Act to provide for the more efficient government of the Rebel States", passed March 2, 1867.
   
I beg leave to submit whether an order from the Hd. Qrs. of the 1. Mil. Distr., to the effect that in such cases trials shall be hereafter conducted in the manner above referred to, would not largely diminish this class of crime in Va.

Gentlemen,
William Kennedy (cold.) presents to these Hd. Qrs. a letter from you to Messrs Ould & Carrington of this City, by which it seems that you have had some charge in a case in behalf of Kennedy on other heirs claimant against the estate of Lewis J. Kennedy, deceased, and E.C. Morgan, who appears to have been the Administrator of the latter.  You particularly allude to an action of Ejectment No 2339.196 Trial Calendar Nov. 7, 1867, which on Jan'y 3rd 1868 was not yet reached.  There also appears a claim against personal assets of Morgan (deceased)
   
Kennedy states that he can procure no information from one Joseph H. Kelly, who appears to have acted as his Agent.  If you will please give such information connected with the rights of Kennedy, and the parties he represents, as will make it possible to afford advise to these ignorant persons, you will oblige.
