GERMAIN SELIGMAN, being duly sworn, deposes and syas:

I make this affidavit in connection with the proposed withdrawal of a petition for the appointment of the Public Administrator as an Administrator of the Estate of Andre J. Seligmann, deceased, and the claim of the Sheriff of the County of New York for poundage.

I am a brother of Andre J. Seligmann, deceased. My brother was born in Paris, and became one of the well-known art dealers of France. With the outbreak of the war and the fall of France, he fled with his family just prior to the arrival of the Germans in Paris. He then came to this country and remained throughout the war.

With the end of the war, my brother was most anxious to return to Paris and to his business. He told me personally that he would not return to the United States, and that as soon as he had made the necessary arrangement, which would take a month or two, he would send for his wife and children. I can testify of my own knowledge that on leaving the United States he had no intention of returning here.

I can also testify of my own knowledge that on leaving the United States he had no assets in this country. I personally loaned sufficient money to his wife for the purpose of paying the rent of the apartment which they occupied during his absence.
