NARA 226

Auburn Miss, Jan. 6th 1868

Mr Allen P. Huggins.

Dear Sir,
I received this morning your communication from the hands of George Jenkins. I enclosed to you the deposition of Wm M. Wells in relation to the Moss referred to in your note to me. I will state to you what I know about the matter. Mr. H.T. Henry employed some hands to gather and prepare moss for market. He got the permition of Wm. M. Wells to gather moss from the forest on a plantation for which the said Wells is agent, at the same time the said Henry rented the press on the plan to put his moss into bales with the understanding that if he injured the press he was to pay for damages. The said Wells gave the said Henry the permision to cut down any of the gum trees on the plan to get the moss of off, and forbid his cutting any other trees. The said Wills tried to collect the rent from the said Henry but failed to get anything but promises. The said Henry ruined the screw and cut down a great deal of timber against orders. The said Wells came to the conclusion that the said Henry did not intend to pay for damages nor rent from the following facts.

The said Henry sold and made to Mr. Griswell at Edwards Depot a Bill of sale all the moss on his yard on the premises, in ashort time after he made a pretended sale of the same moss to his stepson and two negrows George Jinkins & Jim - . The sale to Mr Griswell was understood to be to pay for supplies furnished the said Henry to feed his hands on while gathering moss,
