during the war and who fled to the mountains or to the north to avoid the rebel conscript guard - for assistance, I have yet to find a man who has been a refugee during the war - or who was an outspoken "Union man" who will acknowledge that he believes he would obtain justice in the court as now organized. Had he a suit with a man who had been an active or prominent rebel - 

Some days ago I was requested by a man who fled from home and family during the war to avoid rebel conscription. To be present at a trial he was interested in, the party with whom he had the suit was an active rebel - and he was summoned before a magistrate of the same stripe - and as he did not believe the magistrate would give him justice he requested me to be present and I rode twenty one miles to be present at the hearing - The suit pending was in regard to some lumber that both parties claimed as their personal property. When it became known that I was to be present at the trial and that I had come there for that express purpose, the case was postponed - and has not been heard since.

Now the question naturally arises: was the suit postponed on account of my being present? and if so why?
