NARA 106

Jackson Sept 30th 1867

Capt S. S. Sumner

Dear Sir

After hearing the testimony in the case of Yerger vs Howard I felt it to be my duty to render a verdict for the Plantiff And after seeing that the Defendt was so dissatisfied with the decision advised him to take an appeal to a higher court which it was his privilege to do at any time within five days after Judgment which if he had have done would have stoped all further procedings in the case I told the Lawyer that the defendant had spoken to that I would Grant the appeal at any time as the aplication had been made within the five days but no appeal had yet been taken as yet

yours truly
J. H. Boyd
