States that the Association have helped the Freedmen to build homes upon 3 Farms in York Co. Va, with the assurance on the part of the Comdg officer of the Dist, that they should be protected in holding them &c - The former owners of the land now claim it, and Capt Flagg Supt of Dist states that after the 1st of Jany 1866, there is nothing to prevent their taking possession and ejecting the Freedmen- Asks for definite information so as to provide for the removal of Buildings &c in time

Respty Forw'd to Capt A S. Flagg &c, with the information that by the affidavits; and admissions of the applicant a clear case of abandonment is made out - [left margin note]] Refer 2.B. 235. /left margin note]]  The "private" business attended to seems to have been of more importance in the confederacy than the protection of his property within the Union Lines - and it is a well settled principle of International Law that when a party goes within the lines of an enemy and engages in any kind of trade - he gives aid and comfort to that enemy to the extent to which the wants of that enemy are supplied by his industry & that all the inconveniences and pains attending such a condition of society in time of war attach to him as well as to the actual belegerents. I am of opinion this property should not be given up
