Respectfully forwarded. The within property was leased on the 1st day of September, and the lease was executed on that day, owing to delay in turning over the house by the Q.M. Dept. the lease did not enter upon possession until Sept 20th 1865.
On the 22d of September Judge Baker called and exhibited an order from War Dept. (copy of which is enclosed). As the property was leased on the 1st of September and for six months, the order of the War Dept conditional is it was, could not be obeyed without injury to third parties.
Mr Baker has since procured a pardon a copy of which I have seen.
He forwards herewith proof of title and certificate from clerk of Dist court. This property was turned over to the Bureau by an order from War Dept. approved by the President.
It is rented to Maj McKenney formerly Pay Master U.S.A. The statement within that the lease was dated Sept 20th is not correct.
It dates Sept 1st.

Respectfully forwarded to Maj Genl Howard for instructions. This property has already been restored subject to the lease which was made on the 1st Sept_ Does the want of a stamp on a lease made by an agent of the Gov't invalidate the lease? and is a lease entered into a good faith on the 1st inst. although possession is not to be given until the 20th. made null & void by an order from Bureau Head Quarters of the 12th inst restoring the property.
I am desirous of restoring this property to Judge Baker if it can be done without subjecting the Bureau to a lawsuit.
