The Communication Enclosed is a report in part, in answer to you telegram of Sept 24 dated Lynchburg. The plan to rent three lands to the Freedmen is rendered futile from the Exhorbitant price asked. namely Eight ($8.00) dollars per acre a year. and possession of the houses at the end of the year. - There are 300 hundred in this property. worth at least twenty ($20.00) dollars each and upward. The representation that he has a right to the houses. because the wood was cut on his land, is not true for the wood was cut by the Military Authorities. And he can claim no rights previous to the date of his pardon. The building and rent for one year will be more than equivalent to the full value of the lands

Respectfully forwarded- The applicant has received  a special pardon. Which I have seen. but no evidence has yet been produced that the State Dept has received his acceptance of said pardon. The property applied for was confiscated and turned over to the Bureau by an order from War Dept dated July 26 and approved by the President - I have taken the same ground as on Mr Taylor's Application. [[bin]] - that the decree of confiscation must be dismissed before the Bureau can surrender the property. I have Consulted two Lawyers in the City. and find that they both agree with me and one of them informed me that Judge Underwood had decided that by a decree of Confiscation the United States. acquired a right to the property which could only be restored by a new trial - So long as the decree of confiscation remained. So long must

the rents be received by an Agent of the United States and I respectfully submit that until that decree is reversed. The Bureau cannot surrender its Jurisdiction. The property is occupied by Hon LN Chandler but as yet no rent has been received by the Bureau
