I am sixty-five years of age and live at Louisa C.H. Va. On Saturday the 16" of February 1867 while in Mr. Blurball's Store at Louisa C.H. I was set upon by a man named Charles Phillips in a drunken but not unfriendly manner. Seeing his condition I got away from him as soon as I could and went out of doors. He followed me saying "What do you run from me for" and took my axe away from me, and struck me with his fist and knocked me down, and beat me until I was senseless. I believe he would have killed me if some one had not told him from across the street to stop. I did not at the time know who Phillips was, and I said nothing to him except to let me alone, why do you beat me when I have not pestered you. I made no attempt to resist him at all, and no one there tried to keep him from beating me except that someone holloed from across the street. I went to Mr. Butler a Magistrate who said he would attend to the case but he has done nothing. I have complained to him since and he promised to give me a warrant, but put me off.
