Respectfully referred to Lt J W Sunderland U.S.A. D.O. with remark that, upon consultation with legal council I am informed that in case of failure on the part of an Express Company to fulfill their contract in the forwarding and delivery of goods and packages, either the person forwarding it, or the person to whom addressed may sue for recovery.
Inasmuch as in this case the tho money was forwarded by Express entirely at the dictation of the Distributing Officer, it is believed that the Express Company should be required to answer to him for failing to carry out their contract with him. The receipt to him from the Company is herewith returned.
