instructions were received, at this office, from Hd. Qrs. Asst. Com, Va., to "turn over to the civil authorities, for adjudication, all cases of persons charged with the higher crimes, above mentioned." Compliance with such instructions has been rendered impracticable, by the action of the civil authorities in refusing to make good their former protestations;- voluntarily and persistently presented prior to the issue of said order.

A single case of this nature is submitted as evidence.

Ransom Deetz freedman, was arrested May 15th and brought before the Freedman's Court, for this county, charged with burglary. He was positively identified by three, well known and respectable white citizens of this county, and Mr. J. Richardson, the complainant, was instructed to present the case before one of the magistrates of Hampton. No attention having been paid to the complainant's charge, I called upon Mr. T. W. Roche, magistrate of this dist. and represented the case to him; explaining to him the nature of the evidence and offering to hold the prisoner
