Charles W. Barbour, colored, being duly sworn, states, that on Saturday. January 18th 1868, while coming from Newtown on horseback, he was met on the road by two men on horseback, whom he recognized, as Charles Chamberlain and Fred'k Beyer. "Chamberlain called on me to halt which I did not do. I rode on faster, and they rode on after me. Chamberlain came up on my left side and calling on Beyer by the name of Lieutenant told him to go on the other side. Beyer then came and took hold of me, and finding he was going to pull me from the horse, I slipped off. 

I started off half running between the horses and when about ten steps away I heard the snap of a pistol and immediately after the pistol was fired, and the ball entered my back. I could not see which of the men fired.

Chamberlain when he halted me, and rode up, asked me to hand out my whiskey bottle. I told him I had no whiskey, and did not have any. I know of no cause why I should be attacked by the men, as I had never done them
