failed indict Armstrong because (as the foreman of the Jury afterwards informed me) they thought that Armstrong "only wanted to do the same to her as a husband would".

I instructed Pollard to get a warrant from a Magistrate for Armstrongs arrest, and have him bound over to appear before the next Grand Jury, and steps would then be taken to have the facts properly brought before the said Jury.

The warrant has been issued and is in the hands of the Constable, but Armstrong has not as yet been arrested, he having left the county some time since on account of this affair.
