Respectfully returned. All the wood barracks, huts and timber in breastworks & c in this Dist except what was required for Military purposes was turned over to me in Aug 1865. by Maj Gen'l Hartsuff, then commanding Dist. The wood in question is included in this, and was cut by the U.S. Army. By order from Hd Qrs Asst Com'r this material was removed to an available location as fast as possible. On Maj Gen'l Howards tour through this state in riding from this City to City Point, the matter of this word was brought up by the Supt of Dist. The Maj Gen'l's verbal instructions were to remove as fast as possible and if not required for use, to dispose of the best advantage, to pay if possible expenses of Dist.
For the further information of Gen'l Howard. a young man (whether the petitioner or not is unknown to the Supt)informed this Office that he had purchased the wood for a "mere song" of Mr. Temple. Considering the chances poor for getting possession of it and personally urged the Supt of Dist. to assist in its restoration and enter into partnership with him to remove the wood and ship it North, as he considered it good speculation. this was of course declined. Am of the opinion that Mr. Temples interest in the wood has ceased, and the petitioner is the same man referred to and is asking for himself.

Respectfully returned. The applicant has rec'd a special pardon which I have seen dated Sept 20th 1865. He files herewith evidence that decree of confiscation has been dismissed - He desires now to include in his application House No. 80. Main Street - which was turned over to this Bureau by order from War Dept approved by the President.
While I do not wish to embarass this particular case. I would respectfully ask for information as to the power of a Dist Atty to dismiss a decree of confiscation. While the court is not in session - I am inform by competent legal authority that no such rights exists-  but that either a new trial must be granted or an appeal taken to a higher court- This house was [[strikethrough]]was[[/strikethrough]] ordered to be sold but the sale was postponed with others.

The House is occupied by the Supt of Dist as office and Quarters was set aside by the President for the use of the Bureau and has been leased for one year from Oct 1st to Orlando S. Pride an agent of the Bureau who messes the Supt & clerks of his office.

This Building is needed for officers & c and having been set apart, can it be returned. The rest of Mr. Johnstons property has been restored.
