Continuation of Endorsements on letter of Wm & John Mitchell dated Richmond Va Jan 24"/66 (M. 120) relative to him being arrested and confined on charge of horse stealing preferred by James Lyons. were proved innocent & released. to appeal to Genl Howard that the suit vs Lyons for false imprisonment, which was dismissed by Genl Terry. be allowed to go on.

Respty returned to Col O Brown. The suit mentioned within was discontinued by my order. it could not have been sustained on any principle of law whatever
James Lyons simply gave information to the police of his lose and of the fact that these two men had been see near the stable about the time where the animals were taken. The arrest was made by the police on what was esteemed reasonable grounds of suspicion.
The whole case was the ordinary one of innocent men being arrested on reasonable suspicion.
James Lyons does not appear to have been influenced by any improper motive & therefore no suit can be sustained against him.
In my judgement the suit which I ordered to be discontinued ws vexatious & malicious.
