Continuation of endorsements on letter of James Mims (col'd) (M.131) relative to property of his father (dec'd) which certain parties are trying to defraud the heirs of &c. &c.

On Dec 1st 1865 it was reported to me that depredations were being made on the property referred to, one of the heirs bringing the report. I issued instructions in regard to the protection of the property (a copy of which I enclose) I do not see that the interests of the parties are being jeopardized.

Respty forwarded to Maj. Genl. O.O. Howard Com'r &c for information as to whether the commissioner approves the decision in the following endorsement made on a similar application, viz.

Richmond Va. Feb 20/66
"Inasmuch as the Govt could at any time have sold or disposed of any or all of the stock upon farms which it has held in its possession, and furthermore, as all crops, grown during possession by the govt. are recognized as its property ~ all rents collected and the money so rec'd used by the Gov't ~ all fruits grown during season are made a source of profit ~ there is no reason why increase of stock should be regarded in a different light. This increase is grown under the Breeding and care of the possessors for the time being and should inure to their benefit in the same way as other fruits or results of its protection and possession."
