Respty returned with information that I am entirely guiltless of the heinous charge made against me. 
By reference to my private diary. I find I rec'd a "leave of absence" on the 6th day of April 1863. and reported back for duty, April 23rd 1863.
I drew my pay for the months of January and February of Major T.W. Burt. A.P.M. Washington D.C. on the 7th of April 1863 and on the day which it is alleged. I again drew the same pay I was in command of Co "I" 94th Reg't N.Y. Vols 1st A.C. 2nd Div 2nd Brigade, and by reference to the aforementioned diary I find that I was on the march on the day alleged from "Franklin Crossing" Rappahannock River to the extreme right[[?]] of the Main Army at Chancellorsville Va, where we arrived at a late hour of night and had a skirmish etc. In explanation of being in command of Co "I" 94th Regt N.Y. Vols at the battle of Chancellorsville
I would add that the 105th was consolidated with the 94th N.Y. Vols March 9th 1863.
I would respectfully refer you to Major T.W. Burt as to the truth of my statement, as he stated at the subsequent payment of the Brigade that I had been paid twice for the aforementioned months, but upon examination of the records of the Regiment found that I was in the battle of Chancellorsville upon the very day that the payment was again made, viz April 29th 1863, and was perfectly satisfied

that I had not fraudulently obtained pay for the aforementioned months, and stated that I need apprehend no further difficulty in the matter.
Maj Lee, I am entirely unacquainted with, and he never has paid me since I have been in the service. Abundant testimony can be obtained from officers with whom I was with on the 29th of April, as to my whereabouts at that time.
In conclusion I would most respectfully request a full and severe examination into the alleged charge made against me, as I do not desire that a blot should rest upon my record.
