From representations of the Asst U.S. District Atty it was understood that jurisdiction would be taken of this case by the U.S. Circuit Court. It appears upon further inquiry that this point is not settled: and as the question is one of much nicety, it is not perhaps advisable to make this case a test one, at the same time it is desirable if possible to avoid becoming sole judge in a matter of mixed fact and law. Where so much depends upon balancing probabilities. 
To avoid both difficulties this case may be referred to arbitration if the parties will consent. The submission to be of all questions of law and fact. If this cannot be agreed to the decision of Col Brown will be approved.
It is proper to state that the first endorsement of Col Brown will be approved.
It is proper to state that the first endorsement of Col Brown was considered as an approval of the Commissioner to whom the case was referred.
