land, and though petitioner was not for this temporary period personally present, he continuously occupied by his agent, whose possession in law is the possession of the principal.

According to assessment adopted of 1860 the property of petitioner is in value much up than twenty thousand dollars and at an advanced age in life, with an almost helpless family he thus found himself encompassed by these difficulties, the removal of which, would greatly aid in this needful subsistence Indeed said domicile cannot be even tolerably comfortable without the aid and use of the property

Petitioner has heretofore obtained an order for the immediate occupation of said domicile & other real property, but commandant forbore to act on the past excepted above, referring me to your bureau.

Petitioner has held no office civil or military during the past war, nor at any time has been in the service of the Southern Cause or rebellion, but is a true and loyal citizen of the United Stated and has subscribed and taken the needful oath required by the oathorder of the said United States

Petitioner respectfully submits and asks that he may be remitted to the full and constituted possession and enjoyment of the said premises then rented subject to the right of said tenants for this
