Your Petitioner for the Reasons above set forth, formally solicits that this Property now in possession of the Agents of the Government may be restored to him, as well as the Rents thereof which have been collected from his Tenants. And this Petitioner is in duty bound &c &c.

In consideration of the decision made by Col. Brown of Aug. 3d 1865 made in reference to my application for restoration of property in Norfolk & Portsmouth: and herewith received: from which if it is infered that the property will be restored, when it is made to appear "that it was not a case of abandonment"
And more especially in reference to the provisions of the 6th Sect. of Circular of Gen'l O. Howard Chief of Bureau, bearing date the 12th Sept. 1865. and deciding; "That property in possession of the Bureau as 'abandoned' which does not fall under the definition of abandoned as set forth in Sect. 2d of the Act of [[illegible]] 1866 will be formally surrendered
